100.000 DISCIPLINARY PROCEDURES
100.010 Any officer or member of the Fire Department may be suspended by the Chief of the Department for misconduct or incompetency.
100.020 Such period of suspension cannot extend beyond the next regular or special Board of Fire Commissioners. At such time the Board of Fire Commissioners will consider the matter and determine whether or not to press charges.
100.030 Removal on the grounds of incompetency or misconduct shall be made only after a hearing upon due notice and upon stated charges, with the State of New York.
100.040 The charges shall be in writing and made by the Board of Fire Commissioners, and the burden of proving such charge of incompetency or misconduct shall be upon the person alleging the same.
100.050 Hearing upon the charges shall be held by the Board of Fire Commissioners or by a deputy or employee of the Board of Fire Commissioners designated in writing for that purpose.
100.060 The officer or member so charged shall be given a notice of the hearing, which shall specify the time and place of such hearing and state before whom the hearing will be held.
100.070 Such notice shall be served personally upon the accused officer or member at least ten (10) days, but not more than thirty (30) days before the date of the hearing.
100.080 The Board of Fire Commissioners may suspend an officer or member after the charges are filed and pending disposition of the case.
100.090 Following the hearing the Board of Fire Commissioners may remove or suspend such officer or member.
100.100 The members of the Fire Company may remove an officer or member of the Fire Company for failure to comply with the Constitution and By‑Laws of the Fire Company. Any member suspended by the Fire Company shall be considered suspended by the Fire District.
